Which means that the OP's puzzle is invalid as you can't prove blacks last move was the double step pawn move which would permit e.p. The castling move in #67 is OK since the castling convention is much more forgiving than the e.p. convention.

Btw, the OP position is illegal as well. The conventions don't apply to illegal positions but that does not imply you can make any e.p. move you like. There are no fixed rules for fairy positions but before you could allow for an e.p. move you'd need to define a double step move in the past when there is no past.

But actually, as I wrote in other places, puzzles such as this one ought to be announced as "joke problems". That gives the solver the right to "play with the rules" on top of "playing the position". Of course, joke problems are not an exact science.
